New Rules for MBBS First Year Attempts: Each year, countless students clear the NEET-UG examination, aspiring to gain admission to prestigious government medical institutions. However, only a limited number manage to secure a seat. It is crucial to note that even after gaining admission, a student's enrollment can be revoked. A recent ruling from the Bombay High Court has issued a serious warning to those aiming to pursue a career in medicine.


This case revolves around a female student who enrolled at the Maharashtra University of Health Sciences (MUHS) in August 2023. Despite her commendable NEET score, she exceeded the allowed time to finish her first-year MBBS coursework. Although she passed internal assessments in all subjects except Anatomy, her failure to clear the Anatomy theory exam resulted in the university preventing her from taking further tests. The situation ultimately escalated to the Bombay High Court.


Key Ruling from the Bombay High Court: Maximum of 4 Attempts for MBBS First Year
A bench led by Justice Firdosh P. Pooniwalla and Justice R.I. Chagla took a firm stance during the hearing. The Court stated that MBBS students are permitted a maximum of four attempts—or four years—to pass the first year. This limit is strictly independent of the subjects taken or failed during any attempt.


Student's Defense and Court's Decision:


The student argued that she had only attempted the 'Anatomy' paper three times, thus believing she deserved a fourth chance. However, the High Court rejected her petition, referencing Regulation 21 of the National Medical Commission's (NMC) 'Graduate Medical Education Regulations, 2023'. The court emphasized that these regulations apply uniformly, and no additional attempts can be granted once the four allowed attempts are exhausted.


Duration of the MBBS Course and NMC Regulations:
Total Duration: The MBBS program in India lasts 5.5 years, which includes 4.5 years of academic study followed by a one-year mandatory rotating internship.
Maximum Completion Time: As per the NMC's 2023 amendments, students have a maximum of 10 years to finish their MBBS degree, including the internship.
First Year Regulations: Despite the overall 10-year limit, students are restricted to four attempts (or years) to clear the first year. Failure to do so results in expulsion from the MBBS program.


Advice for Aspiring Medical Students:
Understand Attempt Counting: Each exam taken in the first year counts as one attempt; students do not receive four attempts for each subject.
Seek Remedial Classes Promptly: If facing challenges in subjects like Anatomy or Biochemistry, promptly request additional classes from your professors.
